1. Company Identification

Bekatech BV is a company registered in Belgium.

Full company details are available upon request or on the website.

In these conditions:

  • “Bekatech BV” refers to the company
  • “the client” refers to any natural or legal person subscribing to a service

2. Purpose

This agreement covers the maintenance of heating systems (boilers, etc.).

This is a maintenance contract and not an insurance contract.

No repairs are included unless explicitly stated.

3. Acceptance of Terms

By subscribing to a contract, the client fully accepts these terms and conditions without reservation.

4. Formation of the Contract

The contract is considered valid upon signature and receipt of payment.

No service will be provided without prior payment.

5. Duration and Renewal

The contract is concluded for a period of 12 months.

It is automatically renewed for the same duration unless terminated in writing at least 30 days before the expiry date.

Bekatech BV reserves the right to refuse renewal.

6. Payment

Payment is due immediately upon subscription.

Payment is a prerequisite for any service.

In case of non-payment:

  • services may be suspended
  • the contract may be terminated

7. Nature of Services

The services include:

  • annual maintenance
  • safety inspection
  • cleaning
  • issuance of a certificate

Bekatech BV reserves the right to adjust scheduling based on availability.

8. Travel Costs

Travel costs are included only for annual maintenance.

In case of breakdown, they are charged separately.

No discounts apply to travel costs.

If the client is absent, travel costs may be charged.

9. Breakdown Services

Breakdown services are not included and are charged according to current rates.

Depending on the plan:

  • Comfort: intervention within 72 working hours
  • Serenity: intervention within 48 working hours

These timeframes are indicative and do not constitute a guarantee.

10. Obligation of Means

Bekatech BV is bound by an obligation of means and not an obligation of result.

11. Limitation of Liability

Bekatech BV shall not be held liable for:

  • indirect damages
  • financial losses
  • damages resulting from system failure

Only proven direct damages may be considered.

12. Installation and Compliance

The client guarantees that the installation is:
compliant 
properly maintained 
safe to operate

Any required corrective work remains the client’s responsibility.

13. Existing Installation

The client acknowledges that the installation may have pre-existing defects.

Bekatech BV shall not be held responsible for such defects.

Any required upgrades or compliance work is at the client’s expense.

14. Diagnosis and Technical Decisions

Diagnosis is based on the condition observed at the time of intervention.

Bekatech BV reserves the right to:

  • refuse a repair
  • recommend replacement
  • stop an intervention for safety reasons

15. Availability of Parts

Bekatech BV does not guarantee the availability of spare parts.

In case of unavailability:

  • delays may occur
  • alternative solutions may be proposed

16. Parts and Equipment

Discounts apply only to parts ≤150€ excl. VAT.

Major components are excluded.

17. Water and Fuel Quality

Bekatech BV shall not be held liable for failures caused by:

  • limescale
  • sludge
  • untreated water
  • poor quality fuel

18. Accessibility of Installation

The installation must be accessible, compliant, and safe.

If not:

  • the intervention may be refused
  • costs may be charged

19. Third-Party Work

Bekatech BV shall not be liable for:

  • work carried out by third parties
  • unreported modifications

20. Client Conduct

Any abusive, threatening, or unsafe behavior may result in:

  • immediate termination of the intervention
  • termination of the contract

21. Limitation of Interventions

Bekatech BV reserves the right to limit interventions in case of misuse or excessive use of the service.

22. Intervention Timeframes

Timeframes are indicative, expressed in working days, and do not constitute an obligation of result.

23. Force Majeure

Bekatech BV shall not be held liable in case of force majeure, including but not limited to:

extreme weather conditions, strikes, supplier failures, unavailability of parts, or any unforeseen circumstances beyond its control.

24. Personal Data (GDPR)

Personal data is processed in accordance with applicable regulations (GDPR).

The client has the right to access, rectify, and delete their data.

25. Intellectual Property

All documents remain the exclusive property of Bekatech BV.

26. Termination

The contract may be terminated in case of non-compliance or non-payment.

No refunds will be issued after activation.

27. Interpretation

In case of conflict between documents, these general terms and conditions shall prevail.

28. Partial Invalidity

If any clause is deemed invalid, the remaining provisions shall remain in full force.

29. Applicable Law and Disputes

This contract is governed by Belgian law.

Any disputes fall under the jurisdiction of the courts of the registered office of Bekatech BV.

Important Maintenance Contract Rules:

  • No repairs included.
  • Travel included for maintenance. For repairs, travel is charged based on distance, with no discount.
  • Discounts applicable only on repairs, within the annual limit (Comfort/Serenity).
  • Major parts excluded from discount: any part > 150 euros excl. VAT.

Major Parts (examples): heat exchanger, main exchanger, complete burner, electronic board, fan, gas valve, DHW tank, expansion vessel, and any part > 150 euros excluding VAT.

Travel costs for the maintenance visit are included, ensuring complete peace of mind with no hidden fees.

The Essential contract is designed for customers who want regular, professional maintenance while keeping maximum flexibility. Breakdown services remain available at any time under standard conditions.

With BekaTech, you benefit from a reliable and fast service carried out by qualified technicians, helping extend the lifespan of your boiler and ensuring your daily comfort.


Confort

The Confort contract is designed for customers who want priority service and financial advantages in case of breakdown.

In addition to the mandatory annual maintenance, including full inspection, cleaning, and safety checks of your boiler, you will receive an official certificate and a detailed report after each visit. Travel costs for maintenance are included.

With the Comfort plan, you benefit from priority intervention within 72 hours in case of breakdown, ensuring quick assistance when needed.

You also enjoy 10% discount on labor and common parts (≤150€) during repairs, limited to 2 interventions per year.

The Comfort contract offers the perfect balance between peace of mind, responsiveness, and cost control.


Sérénité

The Serenity contract is the most complete plan, designed to provide total peace of mind and priority support in all situations.

This contract includes the mandatory annual boiler maintenance, with a full system check, cleaning of essential components, and safety verification. After each visit, you receive an official certificate and a detailed report. Travel costs for maintenance are included.

With the Serenity plan, you benefit from enhanced priority intervention within 48 hours in case of breakdown, ensuring maximum responsiveness and comfort.

In case of repairs, you enjoy 15% discount on labor and common parts (≤150€), limited to 2 interventions per year.

The Serenity contract is ideal for customers who want a stress-free solution with fast service, controlled costs, and high-quality professional support throughout the year.
